Governing Conditions for Spanish Gambling Licenses

The Spanish authorities have made up their minds to go tough on awarding licenses to online gambling platforms. But, they are choosing to do it by introducing last minute nasty surprises for gambling platform owners. Recently, the Spanish authorities suddenly asked the applicants to pay up back taxes for a period of four years if they wished to avail licenses! As a result, applicants had to cough up a huge sum of money without flinching if they wished to carry out their gaming operations in Spain. Whereas Bwin paid up almost €33 million, the amount designated for PokerStars was much higher. Earlier, applicants were inclined to believe that the back taxes would only be applicable from the June of 2011.

But, this was not all! There were more such unpleasant surprises in store for applicants on the 1st of June, which were just a few days before the licenses were slated to be issued. The Spanish Regulator went on to state that one of the primary prerequisites for obtaining a Spanish license would be that the operator would have to purge its player list bearing Spanish players and would have to begin afresh from a base of 0. This condition has been levied to ensure that all legally licensed online gambling operators are compelled to begin on an equal footing so that the advantages accrued during the course of the illegal gambling period aren’t carried forward.

Until now, the operators were operating in the Spanish domains with their .com addresses. Players having accounts on these sites would now have to be terminated before online gambling operators can restart their fresh sites with .es addresses. The players would be required to cash out the old addresses, open fresh accounts with the newly built sites, and make renewed deposits in order to play. In the process, players would also have to do away with their VIP tags as operators would not be allowed information transfer from the old sites to the fresh ones. Affiliates would also be affected because the existent links would have to be severed.

The Spanish regulatory authorities have specifically pointed out the operators would not be allowed to transition affiliates or players to the newly established portals they would be operating from. Tagging the accounts of the original affiliates would also not be allowed. These moves would be of huge benefit to the new operators who had not yet entered the online gambling market. Still, it could well prove to be irritating and inconvenient for Spanish players to register all over again. But, the opportunity can be utilized for reevaluating options and switching to fresh operators if necessary.

The Spanish gambling markets go live on the 5th of June. The operators with new licenses weren’t keen to go online on a weekend where technical support could be low and playing volume would he high because it might be difficult to attend to problems. Therefore, even though the licenses have been issued, there would be a delay of few days.

Online Gambling Bill Lacks Support In New Jersey

Senator Ray Leniak had sponsored the online gambling bill for voting in the New Jersey Senate on May 31. But due to lack of political support, from both the Democrats and the Republicans, the bill was not put to vote at all. There have been opinions that it will probably get postponed till autumn session.

The Developments

Earlier in May, the bill had already been passed through the committee level. It had got support from the Senate side. Senator Lesniak, therefore, was very positive about the voting on the bill on May 31.

Nevertheless, Raymond Lesniak had got concerned about Gov. Chris Christie’s political ambitions. Previously, he had lent support for Internet gambling legislation. Christie had vetoed Lesniak’s similar Internet gambling legislation last year.

The said bill included assigning some of the revenue from internet gambling to supplement the state’s horse racing industry. The bill needed to undergo changes and one of them included removing the racing supplement clause.

But Governor Chris Christie provided a wavering support to the bill. This ambivalence on the part of the governor led to weak Republican votes. Yet Lesniak was of the opinion that they would not need these votes for the bill to pass. This is because the New Jersey legislature is largely Democrat-controlled.

Lesniak contributed this wavering support of Christie to presidential politics. According to him, the ambivalent support was the result of strong opposition from Sheldon Adelson. A big Republican donor, Adelson, is also the CEO of Las Vegas Sands casino. He is considered as an important figure who is lending support to Republican Mitt Romney. Romney is thought to be a possible competitor to Christie in his president run.

The Conclusion

As stated earlier, Lesniak had thought that the bill won’t need republic votes to pass in the Democrat-controlled New Jersey legislature.

But there were not enough Democratic votes either to pass the bill. This resulted due to the opposition from the horse racing industry regarding the supplement change. New Jersey Governor Chris Christie also nursed an ambivalent attitude which led to the failure of passing the bill.

Lesniak was of the opinion that the Governor seemed to denote that he preferred the bill not to pass until fall. The general opinion is that Governor Christie is under pressure from the larger party considerations. Especially the Republican Party donors like Adelson may not be in favor if an online gambling bill is being passed. And this could affect his becoming the president, which led him to sacrifice New Jersey online gambling for his own political interests.

Before the happenings, Lesniak had a positive frame of mind regarding the Internet Gambling Bill New Jersey legislature passing to take place by end of June. But with the failure to pass, the wait will be a long shot as the legislature has off in July and August.

There has been a large difference of opinion and a survey even showed that 58 percent of New Jersey residents were against online gambling legislature. But the same margin voters were in favor of sports betting (Fairleigh Dickinson University, PublicMind Poll). What conclusion this controversy will lead to is to be seen and it seems to be a rather long-run process.

MGM International CEO speaks

The MGM Resorts International, which is a leading land-based casino, participated at the 19th Southern Gaming Summit that was convened in Biloxi recently. Here the CEO of MGM Resorts International, Murren, reiterated the need to legalize online gambling in the country. Here, he mentioned his company’s partnership with the European gambling leader bwin.party for a joint gambling initiative once gambling becomes legal in the US. Murren appears very positive about the whole process of legalization of online gambling and is pretty confident that this year will witness the launch of internet gambling in the truest sense of the term. But, he believes that this may not be possible on a federal level as there is no definite move by the federal government in this direction. He feels that the change will come about on a state level. At the same time, he emphasizes his company’s backing of the federal laws because he thinks that this can enforce the law more accurately and only the federal government can add a strong crime prevention angle to it. But, this control by the federal government may not ever happen in the future, according to him, because of the Republicans opposition.

Murren also stressed that the future of social gaming will depend on its convergence with what is called social media. All online gaming giants can exploit their chances to interact with the players and learn from them or partner with them. Social gaming offers a great opportunity to all the companies that are keen to compete and have the infrastructure to do so. He even suggested that MGM had a project on these lines, but a name for this gaming project is yet to be fixed.

Aussie research facts

Sydney’s Gambling Treatment Clinic in a recent research revealed some interesting finds about gambling addictions. This clinic’s Education and Training Officer Anjoul recently declared that gambling is definitely not the kind of addictive behavior it is made out to be. Addiction in gambling can be extensive, but often the tendency to associate it with drug abuse and alcohol addiction is unjustified, according to the clinic’s study. This is because withdrawal and tolerance symptoms which are characteristic of addiction problems in drug addicts or alcoholics are hardly noticeable in the gamblers. Problem gambling is not an effect of malfunctioning of biological processes which an individual fails to gain control of; it is usually the result of poorly informed choices among those who are often not guided properly and develop this addictive habit. This means that the treatment for both should also be different. Anjoul has come up with a unique cognitive therapy process which has shown to have more impressive outcomes than the earlier used methods designed to cure gambling addictions. These treatment methods typically focus on showing people to control their gambling urges. Earlier these would not have long-lasting effects and people would go through relapses. But the current model has shown better results and people trying it have actually been experiencing fewer urges now.

Enforcement Of Online Gambling Schedules Reiterated By Spain

To dispel all doubts about whether the national gambling regulator of Spain, Alejo, would indeed enforce the licenses to the deserving applicants, the home affairs ministry reconfirmed this decision. The doubts had arisen about the likelihood of the regulations not coming into force because there had been changes in the staff and the previous deadline had been extended as well. Moreover, the number of applications had been colossal – nearly 59 applications had been obtained. But, with this announcement, two things became clear: the online services could begin at once and in-play betting would be discouraged. Incidentally, this speculation about the Spanish gambling regulator not being able to deliver his promise rose from the fact that the CEO of 888 Holdings had earlier made a statement to that effect after he had returned from Madrid. He had visited Madrid to assess the progress and he came to the conclusion that the Spanish regulator may need some more time to execute this move. The CEO, Mattingley, nevertheless had been visibly impressed by the regulatory body’s reaction and promptness to incorporate all the changes and ideas suggested to them.

Most European operators running online casinos have also applied for these licenses and hope to achieve them soon enough. In fact, as the deadline keeps getting stretched, they are losing out. At the same time, they have to bear substantial expenses to keep their operations in a state of readiness so that as soon as they obtain the license, they can begin to operate. So, this statement by Mattingley has further added to their frustration. They are now monitoring the prevailing situation to understand in which direction the regulations are likely to move. They are not sure about how much credibility they can attach to the Spanish government’s assurance. Side by side, another cause of concern for these operators has been the growing number of court cases involving these online gambling operators. They fear that local operators might be able to get some kind of injunction to delay the process. For instance, the local Spanish group called Codere has obtained injunctions against foreign gambling operators. In one case, the Madrid Commercial Court decided against Sportingbet. This company is still fighting this case and has applied for a legal permit under the gambling laws of the country. On the basis of meetings with regulators, it hopes to get its license shortly.
