How SOPA And PIPA Can Change The World Of Internet Gambling

Internet freedom is likely to be threatened by two enactments namely the PIPA or Protect Intellectual Property Act and the SOPA or the Stop Online Piracy Act. Although these two actions had been temporarily shelved, it would indeed be interesting to analyze the consequences that they could have otherwise had if they were made legal. There are no chances of there being an immediate voting on these proposed enactments and it is possible that they would be significantly changed eventually before voting takes place.

The effects of these laws on online casino gambling sites will not be felt at once; however, the fact remains, that when the laws get altered, they may lead to future problems for the casino industry flourishing in the country. This is because these laws will bring them a degree of censorship which is likely to revolutionize the ways of the Internet as it functions today and this was bound to have far reaching consequences.

Had these proposed enactments been passed as laws, the US Attorney General could get court orders forcing servers, payment processors and advertisers, blog sites and search engines to blacklist those websites which were suspected to be violating or infringing copyright laws. So this measure would have effectively given third parties like Internet Service Providers and financial institutions, the power to police the Internet gambling world.

Such stringent measures had earlier been adopted to block some gambling websites. This kind of censorship on the Internet may spell doom for the gambling industry in the course of time. These bills, according to Chief Legal Officer of Google, could make it simpler to sue all law-abiding American companies. Moreover, this measure was not enough to eliminate pirate sites because these websites could simply alter their addresses to continue their illicit activities.

Gambling in Asia

Gambling on the internet has become a rage all across the world, whether in countries which have legalized it or in those that have not yet regulated or legalized it. Given this figure, there is the need to legalize online gambling in some of the Asian countries.

A gaming analyst, Jonathan Galaviz, feels that since people would, in any case, practice illegal gambling, it was wiser to tax it instead of letting unlicensed operators amass all the revenues. He mentioned that in Singapore for instance, although online gambling was illegal, it had grown remarkably in the past year. US Department Of Justice’s Changed View On Online Gambling

Following the closure of many online casinos in the United States, year 2011 has been an unfortunate one for the US online gambling market. Numerous major online poker rooms had to shut down their operations in US markets in April this year. Consequently, the online gambling business in the country has smacked an all-time low.

The US Department of Justice has been showing a very strict behavior since April 2011. But now in the last days of the year, it has given a ray of hope to the online gambling business for the coming year. The department has announced that the Wire Act of 1961 will not be applied to online poker or online casino gambling from now onward. The act will only be applied to online sports betting.

The online gambling operators have had a tough time dealing with the US Department of Justice and have paid millions of dollars as fine earlier this year. Several legal actions were taken by the DoJ against many high-profile online casino operators. For them, this change of heart will only be a little consolation as they have already spent so much in dealing with the closure.

The Wire Act 1961 has been re-evaluated by the Office of Legal Counsel. The unit functions under the United States Department of Justice. The change in opinion can unarguably be attributed to this reevaluation. But unfortunately, there is no hope for online sports betting operators despite this reevaluation.

The reevaluation of the act by the Office of Legal Counsel followed questions from the American states of Illinois and New York about selling lottery tickets on internet. The Department of Justice stated that the plans of selling lottery tickets online did not have anything to do with the sports betting. Written by Assistant Attorney General Virginia Seitz, the 13-page opinion was published on September 20, 2011, and said, “Accordingly, we conclude that the proposed lotteries are not within the prohibitions of the Wire Act.”

Besides this, there was another announcement from the US Department of Justice. It said that individual US states had full authority to authorize and control online gambling operations within their territories. But, it should not involve sports betting. The announcement was in response to a letter to DoJ written by Harry Reid, Senate Majority Leader, and Jon Kyl, Senator. The letter asked for explanations on the legitimacy or legality of online gaming.

The Department of Justice made it clear that it has all the rights to scrutinize and take legal action against illegal gambling companies under the UIGEA in the states that ban any or all forms of gambling. The online gambling market experts feel that DoJ has reached its new decision after numerous court decisions.

With this new announcement, the department has given strong indication that online poker as well as other online gambling will be possibly legalized soon. The entire industry hopes that the issue will be carried forward at the same pace created by this announcement. “The time is opportune for federal legislation to curb a proliferation of domestic and foreign, unlicensed and unregulated online gambling states,” as per a statement released by the American Gaming Association.

The crackdowns on several major U.S. online poker sites not only affected the career prospects of several hundred online poker pros but also resulted in thousands of players losing their hard-earned deposits. Nevertheless, for the first time, there is definite hope on the horizon for former Full Tilt Poker patrons.

The Rise and Fall of Full Tilt Poker

Full Tilt Poker has since shut down its operations following the Black Friday indictments, but just a short while back, it was one of the biggest players in the online gambling scene in the United States. Established just a few short years back in 2004, Full Tilt Poker nevertheless enjoyed a fairy–tale, meteoric rise, reaping millions of dollars of profits every year.

Full Tilt Poker was launched by parent company TiltWare, LLC, in June 2004 and began operations on July 2004 with the involvement of several major poker pros, including Andy Bloch, Chris Ferguson Howard Lederer, Jennifer Harman, Mike Matusow, and Phil Ivey. The site offered several online poker rooms and was a major force behind the popularity of online poker tournaments. The Full Tilt Online Poker Series (FTOPS), established in August 2006, had the highest stakes in online poker games, and a hundred of the biggest online pots of 2009 were earned during the 2009 FTOPS.

However, on April 15, 2011, Full Tilt Poker, along with several other online poker operators, had their domains seized by the FBI as part of a series of indictments, which has since been dubbed the “Black Friday” indictments by online poker players.

Players Become Collateral Damage

The Black Friday operations were a major blow to the various online poker sites. In addition to calling the Internet gambling giants to account on several serious criminal charges, including illegal gambling and money laundering, the Department of Justice also froze several of the companies’ main offshore accounts. Full Tilt in particular lost around $40 million as a result of a frozen offshore account. Following the various indictments, Full Tilt completely shut down their operations in June.

The freezing of the accounts of several of the online poker sites, including Full Tilt Poker, by the U.S. Department of Justice meant that the players were unable to reclaim their original deposits, let alone their winnings on the site. Thousands of poker players around the world found themselves out in the cold as they were unable to access the money credited to their accounts.

Hope for the Thousands Who Lost Cash in the Crackdown

However, the latest news indicates a positive outcome is finally in the cards for the beleaguered gamblers as a French investment corporation has started negotiations with the Department of Justice to take over the Full Tilt Poker operations. There is a strong possibility that, as a result of these negotiations, the DOJ might well unfreeze the accounts of the former online poker giant. If this should happen, then users who lost their money to the crackdown may finally appeal to the Department of Justice for compensation as well as a refund on the money in their accounts.

However, while most would agree that reparation for Full Tilt users is only fair, industry insiders are still skeptical about how successful the compensation claims will turn out to be. Many of the former players on the site are nevertheless cautiously optimistic.

Right now, though, everyone concerned is following a strict wait-and-see policy as they keenly observe the tabled negotiations between the French company and the Department of Justice.

Two online gambling hearings took place in quick succession recently. One was organized in the Senate Committee on Indian Affairs, while the other was presented before the Subcommittee on Commerce, Trade, and Manufacturing. The second pertained to the bill forwarded by Representative Barton in an effort to make online poker legal. The first was in connection with legalizing online gaming and suggested the keenness amongst American Indian tribes to have a say in regulatory policies regarding online gambling. Here, representatives of the Committee of Indian Affairs hailing from two distinct tribes offered divergent viewpoints on this issue. The chairman of the Mohegan Tribe Bozsum wanted to regulate online gambling. At the same time, he expressed his wish that the laws must protect the rights of all tribes and should allow them the chance to compete on fair grounds as he believed that the American Indian tribes had the capability to perform as well as others. He did not favor state regulatory laws because that would benefit smaller groups. Tribal casinos must also be granted the right to accept wagers given by nontribal land players. He felt that those online casinos that were not subject to regulations should be banned completely. The Vice Chairman of the Washington state-based Tulalip Tribes protested against gambling online because it threatened the existence of land-based casinos run by the Indians. The huge profits likely to be generated by these casinos are expected to be many more times than the profits likely to be churned out by online casinos. Hence, the ultimate gains through online gaming were not worth taking because they would adversely affect North American gambling profits.

Chairman Ernie Stevens of the National Indian Gaming Association, or NIGA, favored Bozsum’s stand. He believed that online laws must acknowledge the fact that tribes should be given a hand in regulating online gaming. Moreover, he suggested that tribal revenue should not be subject to federal taxation.

U.S. Online Gambling Regulations

The players at online casinos here are hopeful that the federal government will regulate and make online gaming legal. This could effectively stop underage players from gambling online or participating in other illegal activities, namely fraud or money laundering.
